Acceptance of these terms
These terms apply to all use of toptal.expert, including the marketing site, the knowledge base, and the client workspace hosted at app.toptal.expert.
If you use the platform on behalf of a company or another legal entity, you confirm that you are authorized to bind that organization to these terms.
Account and access rules
- You must provide accurate, current, and complete account information.
- You are responsible for keeping login credentials secure and for all activity that occurs under your account.
- You may not share access in a way that bypasses seat, role, or permission controls.
- You must promptly update account details when billing, ownership, or contact information changes.
Payments, contracts, and billing
Payments, invoices, hourly tracking, manual payments, bonuses, and contract actions are governed by the workflow settings selected inside the platform and any written agreement between the parties.
Clients are responsible for maintaining a valid billing method and for reviewing tracked work, invoices, and payment actions within the applicable approval windows.
Freelancers are responsible for providing accurate work submissions, honest time records, and any information reasonably required to complete payment processing and contract performance.
Acceptable use
- Do not use the platform for unlawful, deceptive, fraudulent, or abusive activity.
- Do not attempt to disrupt, probe, reverse engineer, or bypass security, payment, or access controls.
- Do not upload malware, harmful code, or content that interferes with the product or other users.
- Do not misuse the service to store or distribute material that infringes privacy, confidentiality, intellectual property, or third-party rights.
Content, confidentiality, and rights
You retain ownership of the content, files, briefs, and project materials you submit to the platform, subject to the rights necessary for operating, securing, and improving the service.
Each party remains responsible for respecting confidentiality obligations, non-disclosure agreements, and intellectual property terms agreed between clients and freelancers.
Toptal.expert branding, interface design, software, copy, and visual assets remain protected by applicable intellectual property laws and may not be copied or resold without permission.
Service availability and changes
The service may evolve over time. Features, workflows, pricing, support channels, and operational rules may be updated to improve quality, compliance, security, or performance.
While commercially reasonable efforts may be used to keep the platform available, uninterrupted access, error-free operation, or permanent retention of all content cannot be guaranteed.
Liability and indemnity
To the maximum extent permitted by applicable law, the service is provided on an “as available” basis and indirect, incidental, special, consequential, or punitive damages are excluded.
Each user is responsible for their own conduct, project decisions, contractual commitments, and compliance obligations. You agree to indemnify the service provider against losses arising from your unlawful use, breach of these terms, or violation of third-party rights.
Termination
